He was captured June 11, 1864 near Trevillian Station and Louisa Courthouse, Va. After being imprisoned at Fortress Monroe June 20th, he was transferred to Elmira Prison, N.Y. July 25, 1864. Private James I. Futch died August 11, 1864 of chronic diarrhoea.
He was burried in grave 35, section G, Woodlawn Cemetery.
